These Terms and Conditions of Use (“Agreement”) is a legal agreement between you and MYEX, LLC (hereinafter referred to as “Website Owner” or “MY EX”), the owner and developer of website. By registering, using or paying for any service provided on the website, MYEX.BLOG you become a User (“User”, “You”) and you agree to be bound by all of the terms (the “Terms”) set forth in this Agreement as long as you remain a User. LIMITATIONS OF LIABILITY AND INDEMNIFICATION. USER AGREES THAT MY EX, ITS SUBSIDIARIES, AFFILIATES, LICENSORS, LICENSEES, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS WILL NOT BE LIABLE FOR ANY INCIDENTAL, DIRECT, INDIRECT, PUNITIVE, ACTUAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR OTHER DAMAGES, INCLUDING LOSS OF REVENUE OR INCOME, PAIN AND SUFFERING, EMOTIONAL DISTRESS, OR SIMILAR DAMAGES, EVEN IF MY EX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, SUCH DAMAGES WERE REASONABLY FORESEEABLE OR MY EX WAS GROSSLY NEGLIGENT. IN NO EVENT WILL THE COLLECTIVE LIABILITY OF MY EX AND ITS SUBSIDIARIES, AFFILIATES, LICENSORS, SERVICE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, AND DIRECTORS, REGARDLESS OF THE FORM OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE), EXCEED THE FEES PAID BY USER TO MY EX FOR THE APPLICABLE SERVICE OUT OF WHICH SUCH LIABILITY AROSE. [Some jurisdictions do not permit the exclusion or limitation of liability for consequential or incidental damages, and, as such, some portion of the above limitation may not apply to User. In such jurisdictions, the liability of MY EX, its Subsidiaries, Affiliates, Licensors, Licensees, Service Providers, Employees, Agents, Officers, and Directors will be limited to the greatest extent permitted by law.]

You indemnify and agree to defend and hold harmless MY EX, Website Owner, its and their officers, employees, agents, affiliates, licensees and web hosting services and third parties for any losses, costs, liabilities and expenses (including but not limited to court costs, legal fees, awards or settlements) relating to or arising out of your use of MY EX services, including any breach by you of the Terms contained in this Agreement.

Responsibility for Use of Website. You understand and agree that you are solely responsible for your actions and information posted by you. You understand that MY EX does not perform psychological testing or background checks on the individuals who may use the website services. MY EX is a social network where people share their life experience with their former spouses or partners.

Users are prohibited from sharing personal identifiable information about yourself or others. Personal identifiable information means Social Security Numbers, Driver’s license numbers, and any and all other official documentation.

Users may not post or use personal contact information such as email addresses, passwords, physical addresses, telephone numbers, etc. Users shall not post the real names, addresses or telephone numbers of any person including their own information.

Users are prohibited from posting financial information about yourself or others. Financial information includes but is not limited to, bank account information, login details to financial accounts, credit or debit card information, pin numbers, business or personal financial information/records. You should insure that no copyrights or trademarks are infringed in your posts.

Users are prohibited from posting images of any restricted information described in the Terms and Conditions. Users are prohibited of posting any images of sexual activity, nudity, pornography of any kind, and any other images that in the judgment of MY EX is offensive, demeaning, distasteful and/or abusive.

Users shall not post hate speech which is defined as an attack on an individual on the basis of their race, ethnicity, sexual orientation, faith, religion, national origin or any other protected classification. Users shall not engage in bullying or intimidation of others.

Users who violate any terms and conditions of the Website will be removed from the site and their account disabled. MY EX, in its sole discretion, reserves the right to terminate your access to the Website at any time for any reason without notice to you.

Ownership, Copyrights, Trademarks, Licenses. MY EX owns and retain all proprietary rights to the MY EX’s trademarks and copyrights. Except for any information that is in the public domain, you are not authorized to reproduce, transmit or distribute the proprietary information of MY EX.

No Warranties. MY EX and Website Owner provide the services on an “as is” basis and do not make any warranty, express, implied, limited or other with respect to the services provided. Specifically, MY EX and Website Owner do not warrant that the service will always be available, be uninterrupted, be error free, meet your requirements, or that any defects in the services will be corrected.

Jurisdiction. This Agreement or any dispute arising from this Agreement is governed by the laws of Maryland, without regard to provisions of conflicts of law.

Severability. If any provision is found to be invalid, the remaining provisions will be in full force and effect.

Certification. You certify that you are at least 18 years of age and that your answers to the registration materials for participation on this Website will be truthful. In accessing and using MY EX, you understand and agree that basic information concerning you, given to MY EX, may be provided to third parties pursuant to our privacy policy. Your name, address and e-mail address are kept confidential. It is our policy to release a User’s personal identifying information and any other information when we reasonably believe such disclosure is appropriate to comply with applicable law, to enforce any of our contracts or agreements, to protect the rights, property or safety of our users and customers, in response to a governmental authority request or legal process, or for purposes of fraud protection. By accepting this Agreement you waive all rights and agree to hold MY EX and Website Owner harmless from any claims resulting from any action taken by MY EX during or as a result of its investigations and/or from any actions taken as a consequence of investigations by either MY EX or law enforcement authorities.

Entire Agreement. This Agreement constitutes your entire Agreement with MY EX and Website Owner with respect to any services.

Waiver. The failure of Website or Website Owner to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. Any waiver of this Agreement by Website or Website Owner must be in writing and signed by an authorized representative of the Website Owner.
